Terms and conditions of entry

Rules of the Race

The 2019 Grand Brighton Half Marathon is organised and administered by The Sussex Beacon Limited (Charity Number 298388) whose registered office is at Bevendean Road, Brighton, East Sussex BN2 4DE. (“we” or “us” which expression includes our employees, event officials, authorised agents, sub-contractors or volunteers)

 Closing Date for entries

Closing date for entries: 26th January 2019 or when the race limit of 13,000 registrations has been reached.

Age

Entrants must be aged at least 17 years of age on the 24/02/19.

Personal health and fitness

You understand that participating in this event is potentially hazardous, and you should not enter and participate unless you are medically able and properly trained.

We recommend that you consult your doctor prior to undertaking training for a half marathon. It is your responsibility to make sure you are medically fit and capable of running the Brighton Half Marathon. We reserve the right, in our absolute discretion, to stop any runner from taking part if we deem him or her unfit to run, including mid-race removal from the course where necessary.

Medical treatment while attending the Grand Brighton Half Marathon

By entering this event, you are confirming that should you require any medical treatments during your attendance at the event, whether before, during or after the actual run, they may be administered by the events’ official medically qualified personnel.

Race Number Transfers

You must not under any circumstances give your race number to anyone else. Amongst other potential problems, doing so may cause problems of identification for the event medical services in the case of any accident or injury. Any attempt to do so will result in immediate disqualification of the individual(s) concerned and ejection from the event.

Race Numbers

All runners are required to complete emergency contact and medical information details on the back of their race number. Please complete the relevant medical details on the back of the race number if you have any medical condition or are taking any medication(s).

Refunds and Cancellations

No refunds are given. This applies also if the race has to be cancelled or postponed due to circumstances outside our control, for instance due to a bomb scare. Your entry fee is invested in the cost of staging the event, and the main costs to contractors, suppliers, administration etc. are already committed well before race day.

Furthermore, most races do not offer any form of refund at all if a runner decides to cancel their place because of injury, illness, lack of training or change of plan. There are many other instances of higher priced services, such as plane, train or theatre tickets where no refunds can be given for cancellation in these circumstances.

We reserve the right to refuse or cancel applications, including duplicate applications, or alter the date of the event, the course route or distance.

Duplicate entries

Duplicate entries made in genuine error will be refunded in full.

We reserve the right to cancel all entries and donate all entry fees to one of the race charities where we have reason to believe that duplicate entries have been deliberately made by an applicant with the intention of subsequent re-sale - i.e. ‘ticket touting’.

Where duplicate entries are made for different categories of entry we reserve the right to decide which category of entry will apply and which will be cancelled. For instance, where an applicant has applied for both a general public place and a reserved fundraising place (e.g. official race charity or corporate challenge) we will normally decide to cancel the general public place in favour of the fundraising place.

Bikes, stilts, roller skates, skate boards, buggies, etc.

Participants are not permitted to use any of the above or similar in the event and those attempting to do so will be prohibited from starting and may be forcibly removed from the course mid-race where necessary. Likewise, anyone attempting to start or join the race in any outfit that we, in our absolute discretion, deem unsuitable and/or dangerous to other competitors or spectators, will not be allowed to start the event or, if on the course, may be forcibly removed from the event

Wheelchairs

Participants not taking part in the official wheelchair race (and subject to a separate registration process) must speak to the race team in the first instance to ensure confirmation of entry.

Animals

Animals will not be permitted on the Brighton Half Marathon course. We are unable to allow guide dogs on the course but can offer a free place to guide runners. E-mail us at half.marathon@sussexbeacon.org.uk

Travelling to the event

By signing up to take part in this event you accept complete responsibility for any injury or accident which may occur while you are travelling to or from the event, during the event, or while on the premises of the event save to the extent any injury or accident which is caused by our negligence.

Race ejection

We reserve the right, in our absolute discretion, to refuse to allow you to participate in the event either at the start or to continue participation at any point along the route of the event, should you be deemed to behave inappropriately or give cause for concern that your continued participation may cause offence or injury to yourself, any spectators or other competitors. This includes the wearing of any clothing or visual messages that may cause offence. Failure to comply with any instruction from race officials and marshals will result in ejection from the race and may also result in you being reported to the police.

Your personal data: Collection, use and retention of information

The Sussex Beacon is the data controller for the Event.

You acknowledge that the Event Organiser collects personal data from you when you submit your online registration form to take part in The Grand Brighton Half Marathon. The Event Organiser shall share personal data as is necessary in the administration and organisation of the Event and future events with its data processors.

The Event Organiser’s data processor is Race Ahead, which provides the online registration form and securely stores and manages your personal data.

Your data is hosted on servers in the UK and no data passes outside of the UK.

Your personal information will only be used by us and any appointed third parties for purposes in connection with the event and any subsequent events that we may organise or administer. 

We will process and share your personal data for the following purposes:

- to administer your online account

- to send you information about the event, including health and safety information

- if you actively opt in to being contacted by The Sussex Beacon about other events organised by the charity

- if you actively opt in to being contacted by one of our event partners or sponsors

- to monitor, develop and improve the services we provide to you and/or your experience of the website

- to comply with our statutory and regulatory obligations or as required by law.

By third parties, we refer to partners that are essential to the organisation of the event, including without limitation, our timing supplier who supply and post out race numbers prior to the event and send race results via SMS on race day, our medical supplier who may require access to your information should you require medical assistance during the event, and race photographers. By entering the event you grant full and irrevocable permission for us to pass any medical details you have given us to the medical teams operating on the day of the event.

After race day we will discard information we hold about you which is no longer required unless a longer or shorter retention period is required by law, is necessary during legal proceedings or is otherwise needed for a particular purpose under applicable law

We will however retain your name, email address and the race year you entered should we need to contact you regarding a previous event, and to inform you of new Brighton Half Marathon events.

We will also keep your personal information for two years from your last interaction with us, such as the date of request for a registration to be deleted, your last purchase from our shop, or in some other way contacted or interacted with us.

The following are examples to illustrate how we keep your personal information for as long as necessary for a particular purpose:

  • we may keep your personal information collected during a purchase for as long as required by tax laws
  • we may keep your personal information for a shorter period if you ask us to delete your personal information. In such a case we will aim to delete your personal information within a maximum period of one month from the date of the request;

We will discard all information held after five years.

To opt-out of receiving any communications from a third party, you will need to contact the applicable third party. The Event Organiser is not responsible for the communications or the content of any communications you receive from any such third party.

A participant may obtain a copy of his or her personal data which is held by the Event Organiser by contacting the Event Organiser in writing at: half.marathon@sussexbeacon.org.uk , 10 Bevendean Rd, Brighton BN2 4DE

Use of image

By taking part in the event you grant full and irrevocable permission to us, as organisers of the Brighton Half Marathon, and any third parties authorised by us to use any photographs, videotapes, motion pictures, website images, recordings or any other record of this event that may include your image.

Cancellation of the event

We reserve the right, in our absolute discretion, to cancel, delay or postpone the event due to unforeseen or unavoidable circumstances out of our reasonable control. In such cases, we will endeavour to inform participants as quickly as is possible. Where the event has to be cancelled, delayed or postponed due to circumstances outside of our reasonable control (including for the avoidance of doubt due to adverse weather conditions or because of instructions from the emergency services) we shall not be liable for any inconvenience, expenses, costs, losses or damages suffered by participants. Where the event has to be cancelled, delayed or postponed due to circumstances that were within our reasonable control, our entire liability in respect of any inconvenience, expenses, costs, losses or damages suffered by you as a result will be limited to the entry price you have paid to take part in the event.

Disclaimer

Participation in the event is entirely at your own risk and by entering the event participants acknowledge that we shall not be liable for death, injury, loss or damage arising from participation in the event save to the extent that it is caused by our negligence.

I understand that participating in this event is potentially hazardous, and that I should not enter and participate unless I am medically able and properly trained.

In consideration of the acceptance of this entry, I assume full and complete responsibility for any injury or accident which may occur while I am traveling to or from the event, during the event, or while I am on the premises of the event.

I also am aware of and assume all risks associated with participating in this event, including but not limited to falls, contact with other participants, effect of weather, traffic, and conditions of the road. I, for myself and my heirs and executors, hereby waive, release and forever discharge the event organizers, sponsors, promoters and each of their agents, representatives, successors and assigns, and all other persons associated with the event, for all my liabilities, claims, actions, or damages that I may have against them arising out of or in any way connected with my participation in this event.

I understand that this waiver includes any claims, whether caused by negligence, the action or inaction of any of the above parties, or otherwise.

I hereby grant full permission to any and all of the above parties to use any photographs, videotapes, motion pictures, website images, recordings or any other record of this event.

 


TERMS AND CONDITIONS OF SALE

CANBOOK.me provides venue operators and event managers ("Event Holders") with a service which allows them to sell tickets ("Tickets") to events held or managed by those Event Holders ("Events"). CANBOOK.me also provides the facility for Event Holders to sell merchandise associated with their Events ("Merchandise") and in the case of certain charitable Events, to solicit donations in respect of those Events ("Donations").

CANBOOK.me will permit you, the customer, to place orders and pay for orders for Tickets and Merchandise in respect of Events and in the case of charitable Events, to pay Donations.

Your use of the Service (as described below) and your purchase of Tickets, Merchandise or payment of Donations is governed by the terms and conditions set out below ("this Agreement"). This Agreement forms a binding legal agreement between you and CANBOOK.me. You should read the terms and conditions of this Agreement carefully.

Without limiting the way in which you may be bound by this Agreement, by signing a document agreeing to be bound by this Agreement, by clicking a button on your computer screen including your acceptance of this Agreement, or by proceeding to purchase any Tickets, Merchandise or make Donations through the Service, you will be deemed to have accepted and will be bound by the terms and conditions of this Agreement.

THE SERVICE

CANBOOK.me will provide you with the following ("Service"):

  • A secure payment facility to enable you to pay for Tickets, Merchandise and Donations for Events held by Event Holders.
  • The provision of a receipt in respect of the payments you have made.
  • The supply and delivery to you of Tickets which you have purchased if required. Such Tickets if required will be delivered in an electronic format nominated by you at the time of purchase which will be either to print the Ticket as displayed to you on screen, send you an email containing the Ticket as an attachment or send your Ticket to you as an SMS to your mobile phone. If CANBOOK.me is not supplying a ticket for a particular event, then the Event Holder will be responsible for supplying a ticket to you.
  • In respect of certain Events, you may select particular seating for that Event.

CANBOOK.me will not be responsible for the supply or delivery of Merchandise to you. The Event Holder or its representatives are responsible for supplying Merchandise to you.

The above Service constitutes CANBOOK.me's only obligations to you in respect of the supply of Tickets, Merchandise or payment of Donations.

CANBOOK.me may refuse to sell or supply any Tickets or Merchandise to you or process any payment of Donations made by you at any time in its sole and absolute discretion including, without limitation, where you use the Service in an illegal, fraudulent, offensive or unethical manner or make any use of the Service which in CANBOOK.me's sole opinion is likely to bring CANBOOK.me into disrepute or to impact the use of the Service by CANBOOK.me's other customers.

CONDITIONS OF SALE

The following conditions apply to the sale of Tickets and Merchandise and payment of Donations and also to your attendance at an Event:

  1. Tickets, Merchandise and Donations must be paid for by credit card or other alternate payment methods offered by CANBOOK.me from time to time. A purchase will not be processed unless you correctly provide all information requested by CANBOOK.me at the time of purchase.
  2. In addition to the price you pay for Tickets, Merchandise or Donations, you may be required to pay certain fees and charges which CANBOOK.me imposes from time to time including, without limitation, any booking fees or handling charges.
  3. GST and other taxes may apply to the sale/purchase/payment of Tickets, Merchandise or Donations. Unless otherwise stated at the time of payment, the prices of Tickets, Merchandise or Donations will be inclusive of GST and other applicable taxes.
  4. There is no refund or exchange on any Donation, Ticket or Merchandise except as required by law and as otherwise specified by the Event Holder. If a refund is made, CANBOOK.me may, to the extent permitted by law, retain any booking fee or other fees and charges which CANBOOK.me has charged you.
  5. You acknowledge that the Event Holder may add, withdraw, reschedule or substitute artists, acts, entertainment, and/or vary advertised programs, prices, venues, seating arrangements and audience capacity.
  6. CANBOOK.me may charge a fee for the replacement of Tickets which are lost or stolen. CANBOOK.me will be under no obligation to replace general admission Tickets (which are Tickets where seating is not allocated).
  7. The right of admission is reserved and is subject to the Event Holder's and the respective venue's terms of admission, copies of which may be obtained from the Event Holder. Late arrival may result in admission to the Event being refused.
  8. If a concession Ticket is purchased, you may be required to provide valid identification to substantiate any concession at the time of collection of the Tickets or entry to the relevant venue.
  9. The Event may ban cameras, audio and video recording equipment.
  10. Events may be broadcast on television, radio or over the internet. As a result of your attendance at the Event, you may appear in these broadcasts with or without your knowledge or consent.
  11. It may be a condition of entry to individual Events that a search of person and / or their possessions will be required at the time of the entry to the relevant venue.
  12. Entry may be refused to an Event if Tickets are damaged or defaced in any way or are not purchased from CANBOOK.me or other authorised points of sale.
  13. You must not, without the prior written consent of CANBOOK.me or the Event Holder, resell or offer for sale any Tickets you have purchased at a premium to their purchase price. You cannot resell the Tickets on an online auction site. If a Ticket is sold or used in breach of this condition, the Ticket may be cancelled without a refund and the holder of the Ticket may be refused admission to the Event.
  14. You acknowledge that the resale of Tickets in certain circumstances may breach certain laws (including, without limitation, laws related to scalping).
  15. When purchasing your Tickets or Merchandise, you must allow sufficient time for their collection and delivery prior to the Event.

LIABILITY AND DISCLAIMER

Tickets, Merchandise and the collection of Donations are sold/provided by CANBOOK.me on behalf of the Event Holder. Any legal agreement or contract in relation to the sale of Tickets, Merchandise or the collection of Donations ("Supply Agreement") is between you and the Event Holder. CANBOOK.me's only obligation to you in respect of an Event is the provision of the Service in accordance with this Agreement.

You agree that CANBOOK.me will not be liable or responsible to you for any act, omission or negligence in connection with an Event nor for any act, omission or negligence of the Event Holder in any way whatsoever including, without limitation:

  1. Any failure of the Event Holder to honour any representations, warranties, undertakings or fulfil their other obligations in respect of the Event, the supply of Tickets or Merchandise or in respect of any donations.
  2. Any failure of the Event Holder to comply with the terms of the Supply Agreement.
  3. Any failure of the Event Holder to fulfil any other obligation to you, including, without limitation, any obligation arising under any law.

You acknowledge that CANBOOK.me has made no warranties that the Service will be error free.

You agree that CANBOOK.me will not be liable or responsible for any failure in, or delay to, the provision of the Service or in CANBOOK.me complying with its obligations under this Agreement where such failure or delay has a arisen as a direct or indirect result of:

  1. fire, earthquake, storm, flood, hurricane, inclement weather or other act of God, war, terrorism, explosion, sabotage, industrial accident or an industrial strike;
  2. denial of service attacks, telecommunications failure, hardware failure or the failure of software provided by a third party to function in accordance with its specifications;
  3. a significant demand being placed on CANBOOK.me's services which is above the usual level of demand and which results in a failure of CANBOOK.me's software and hardware to function correctly;
  4. the failure of any third party (including without limitation, any bank or other financial organisation) to fulfil any obligations to CANBOOK.me; or
  5. any other circumstances or event similar to the above which are beyond the reasonable control of CANBOOK.me.

You acknowledge that CANBOOK.me has not made and will not make any express or implied warranties in relation to the Service or any other goods or services provided by CANBOOK.me under this Agreement, other than those warranties contained in this Agreement. Subject to the following, any term that would be implied into this Agreement, including without limitation any condition or warranty, is hereby excluded.

Subject to the following, you agree that CANBOOK.me will not be liable in respect of any claim by you (whether contractual, tortious, statutory or otherwise) for any direct, special, incidental, indirect or consequential damages or injury including, but not limited to, any loss of profits, contracts, revenue or data arising out of or in connection with the provision of the Service or the provision of any other goods or services under this Agreement and whether as a result of any breach or default, by CANBOOK.me. The maximum liability of CANBOOK.me under this Agreement for any and all breaches of this Agreement will not exceed the total amounts paid by you for any Tickets, Merchandise or Donations.

If the Trade Practices Act 1974 (Cth) (or analogous legislation) applies to this Agreement and permits the limitation of liability for breach of warranty implied by statute, the liability of CANBOOK.me is limited, at the option of CANBOOK.me, to:

  1. in the case of goods, any one or more of the following:
    1. the replacement of the goods or the supply of equivalent goods;
    2. the repair of the goods;
    3. the payment of the cost of replacing the goods or of acquiring equivalent goods; or
    4. the payment of the cost of having the goods repaired; and
  2. in the case of services:
    1. the supplying of the services again; or
    2. the payment of the cost of having the services supplied again.

Any of the terms and conditions of this Agreement which limit or exclude any term, condition or warranty, express or implied, or the liability of CANBOOK.me will apply to the extent permitted by law and will not be construed as excluding, qualifying or limiting your statutory rights or remedies arising by virtue of the breach of any implied term of this Agreement where such exclusion, qualification or limitation would be prohibited by statute.

DISPUTES, QUESTIONS, CONCERNS

This Agreement is governed by the laws of the State of Victoria, Australia. You agree that you submit to the exclusive jurisdiction of the courts of the State of Victoria, Australia in respect of any dispute arising under this Agreement.
